
GENERAL TERMS AND CONDITIONS
SITBACK PRODUCCIONS S.L., whose company tax number is B-66014218 and whose registered offices are at Carrer Llepant 33, 3r, 08800 Vilanova i la Geltrú (Barcelona) (hereinafter “SITBACK PRODUCCIONS” or “the Organizer”) is the organizer of “Festival Vida 2023” on the 29th 30th of June and July 1, 2023 (from now on, it will be called the “Life Festival 2023” or the “Event”).
Global emergency situations similar to Covid-19 could force the Organization to implement exceptional measures, with the aim of preserving the safety and health of those attending the “Festival Vida 2023” (henceforth, they will be referred to as the participants), which may cause variations of all kinds as a result of the indications that, at any time, may be established by the competent authorities and which will be notified by the Organization to the ticket buyers, as soon as we become aware of them.
For this reason, the conditions of admission and site use at the Event that are outlined herein will be subject to the public health regulations to prevent Covid-19 infection that are in force at a particular time and may be altered if new measures are adopted that alter the conditions in force at the time of the purchase of the ticket.
The following are the conditions for attendance of the Event that will be considered to be accepted upon purchasing a ticket:
I.- TICKET PURCHASE
The ticket or invitation constitutes a license that allows the holder to attend the performance indicated once only. The resale of tickets is not permitted.
During the process of purchasing the ticket, the Organizer will request the name and surname(s) of the Participant, their phone number and the email address to which to send the ticket. This information will be used to carry out the processes described herein. The Organizer accepts no responsibility for any effects that derive from errors in the phone number and/or the email address or in any other personal details supplied during the process of purchasing the ticket. The provision of this personal data during the process of purchasing the ticket entails the effective consent of their holder to its being processed for the ends described.
The data of a personal nature that is provided will become part of a file that will be managed by SITBACK PRODUCCIONS S.L., whose company tax number is B-66014218, whose registered offices are at Carrer Llepant 33, 3r, 08800 Vilanova i la Geltrú (Barcelona) and whose email address is info@vidafestival.com.
The data provided will be stored as long as necessary to carry out the ends for which it was collected and for the period required to fulfil legal obligations. In accordance with the provisions of Spanish Law of 3/2018, of 5 December, on the Protection of Personal Data, the Participant has the right to access this information, to rectify any information that is inaccurate and to request its erasure or restriction when it is not necessary for the ends for which it was collected, as well as to exercise their rights to object to its use and to data portability if applicable. To exercise any of these rights, they will have to submit a written request to the following address: Llepant 33, 3r, 08800 Vilanova i la Geltrú (Barcelona). If they consider their rights to personal data protection to have been infringed they may submit a complaint to the Spanish Data Protection Agency (www.agpd.es).
II.- MINORS
The conditions of admission to the Event for minors are as follows:
- Minors between 0 and 15 years old (inclusive) must be accompanied by their mother, father or legal guardian.
- Minors of 16 years or older may enter the site unaccompanied if they present written permission signed by their father, mother or legal guardian and the liability exemption document.
If the minor is required to be accompanied in order to enter to the Event, their father, mother or legal guardian must show their Spanish national identity card or equivalent identity document and the official family record book or equivalent legal document that is proof of the accompanying adult’s relationship with the minor. They will also have to carry their Spanish national identity card or equivalent identity document at all times in case the Organizer requires proof of their identity. All minors will also be identified by a wristband which must be worn and visible at all times.
If the adult accompanying the minor is not their father, mother, or guardian legal, the accompanying adult must show an authorization document signed by the minor’s father, mother or legal guardian of the minor, together with a photocopy of the Spanish national identity card or equivalent identity document of the minor’s father, mother or legal guardian, and the official family record book or equivalent legal document that is proof of the minor’s relationship with the adult who has signed the authorization document. The person authorized to accompany the minor must be over 18.
In any case, the person responsible for the minor must sign a document, which will be provided by the Organizer, exempting the Organizer from all liability.
The accompanying adult will be responsible for any action or omission committed by the minor while they are at the Event.
Notwithstanding the above, if the relevant authorities and/or any applicable regulations prohibit the entry of minors to the Event, the Organizer will not allow them to enter and will proceed to reimburse the price of the ticket.
III.- TICKET CHANGES AND REFUNDS POLICY
Once the Participant has acquired a ticket, the ticket will not be changed and its value is not refundable.
The Organizer reserves the right to alter or modify the program of the Event. Examples of this kind of alteration or modification could include, but are not limited to, the substitution of one artist or group for another, the cancellation of a particular performance, a change to the order initially planned or a change to the advertised start time. If the Organizer alters or modifies the program, the Participant will not be entitled to a refund of the ticket price paid.
The total or partial cancellation of the Event due to unforeseeable circumstances or force majeure not attributable to the Organizer will not entitle ticket holders to a refund of the ticket price, except in those cases where this is explicitly established on legal grounds, in which case the ticket holder may request a refund of the price of the ticket in accordance with the procedure and the terms of which they are notified by the Organizer.
No entitlement to a refund of the ticket price will be established in the event that the cancellation or modification takes place after the Event has begun and is due to unforeseeable circumstances or force majeure.
“Force majeure” will be understood to mean any situation or event beyond the reasonable control of the parties that directly affects the Event and makes it impossible, unviable or unsafe for it to be held. This includes but is not limited to the threat of terrorism or war, disasters, epidemics, illnesses, pandemics, (including Covid-19 and possible variations thereof), acts or regulations of any authority or public body, fire, explosions, strikes or blockades (beyond the direct or indirect control of either party), interruptions to or collapse of transport, failure of the national or local grid, earthquakes and/or unpredictable, dangerous or extreme meteorological conditions. Adverse weather conditions do not entitle ticket holders to a refund of the price of their ticket.
If due to force majeure or other duly justified reasons it is not possible to start the event, the Organizer may establish a new date, for which the same ticket will be valid, without entitling the ticket holder to a refund of the ticket price unless the new date differs by more than one month from that shown on the ticket. If the event is cancelled completely, the price of the ticket will be reimbursed within a period of 15 days from the date indicated on the ticket by whichever method the Organizer considers appropriate.
If, due to reasons beyond the control of the Organizer, any artist among those advertised cancels their performance before the day of the concert or on the same day on justifiable grounds, the Organizer reserves the right to replace them, or not, with another similar artist, if time allows, without in any case reimbursing the ticket price as long as the event takes place with the remaining artists.
IV.- EVENT DYNAMICS
All those attending the event recognize its nature as a mass-gathering live music festival and accept exclusive responsibility for all risks to their person and their property that may be occasioned as a consequence.
The Organizer reserves the right to implement any preventive measures necessary to ensure the enjoyment of the festival in accordance with all relevant public health recommendations in force at the time at which the event is held.
The use of public transport is recommended for those attending the festival.
V.- REASONS FOR REFUSAL OF ADMISSION TO THE EVENT
Admission will be refused to any Participant:
– if the Participant displays violent attitudes or publicly incites hatred, violence or discrimination on the basis of birth, race, sex, religion, opinion, disability, sexual orientation, gender identity or any other condition or social or personal circumstance. Also, and especially, if the Participant behaves in an aggressive manner or causes a disturbance outside the site or at the entrance, carries weapons or objects capable of being used as weapons or wears clothes, objects or symbols that incite violence or promote activities contrary to the fundamental rights recognized under Spanish Law and the Spanish Constitution.
– if the Participant shows signs of intoxication or appears to be consuming or to have consumed drugs or intoxicating substances.
When entering the site, the Participant may be subject to search in accordance with the law. Entry is not permitted with cans, bottles, weapons, umbrellas or any other sharp or blunt instruments that the Organizer judges to be dangerous.
The ticket holder accepts that they may be searched in accordance with the law when entering the site, with the sole intention of confirming that they meet all enforceable safety conditions, for which reason admission to the site will be denied to any person who refuses to be searched.
Likewise, the Organizer may refuse entry to the site to any ticket holder if they have reasonable grounds to believe that by allowing them admission they could give rise to a situation of risk, danger, or public disorder. By the same token, the Organizer may expel any ticket holder from the site on the grounds outlined above.
If any ticket shows signs of damage, emendation, alteration or forgery, the Organizer will be authorized to deny the ticket holder access to the site.
VI.- IMAGE RIGHTS
Filming, recording or capturing images inside the Event for any use that is not strictly personal is forbidden. If any Participant fails to respect this obligation, they shall fully accept any liability that may arise with respect to third parties for the capture and unauthorized use of any image inside the Event.
The ticket holder recognizes that they may appear in images taken inside the site — both by the Organizer and sponsors of the Event, and by different media outlets — for journalistic and/or commercial use, and authorizes this use, for which the publisher will be liable. These images may appear on the Internet and thus their dissemination may not be subject to control.
VII.- INTELLECTUAL AND INDUSTRIAL PROPERTY
The Organizer reserves all intellectual, industrial and analogous property rights over the Event and its content. Consequently, the reproduction, distribution, communication to the public, and transformation of the Event by Participants, without the previous and express authorization of the Organizer, is forbidden.
Ownership of a ticket does not entitle its holder or any third parties to use the ticket or its content in advertising, marketing or promotional campaigns (including competitions, gifts or prize draws). Failure to comply with this stipulation will oblige the advertiser or unauthorized user to pay a fine equivalent to one thousand times the price of the most expensive ticket.
VIII.- LIABILITY DISCLAIMER
The Organizer does not guarantee the authenticity of nor do they accept any responsibility for tickets that have not been acquired through official points of sale, whether online or in person.
Each Participant is responsible for the safekeeping of their ticket and accepts responsibility for all consequences that may derive from its being duplicated, photocopied or falsified. The Organizer accepts no responsibility for the loss or theft of tickets.
The Organizer will not offer any cloakroom services and will not in any case be responsible for the loss or theft of the personal possessions of Participants due to the actions or omissions of third parties not to attribute the Organizer while entering the site and during the Event.
